The book reveals that Arkham Asylum is left almost deserted after the introduction of the Dent Act, which sees almost all criminals housed in Blackgate Prison.
"The worst of the worst were sent here, except for the Joker, who, rumour had it, was locked away as Arkham's sole remaining inmate," reads the novelisation.
"Or perhaps he escaped. Nobody was really sure. Not even Selina."
Nolan said earlier in the year that The Dark Knight Rises would not reference the Joker at all in light of the tragic death of Heath Ledger, who portrayed the villain in the 2008 movie.
The Dark Knight Rises novelisation is available now from Titan Books.

Look the idea the' Joker would've been the 'judge'' is ludacris... if Ledger lived the whole film would have been different... the reasons below are still valid... to small for the Joker to cameo like that... when they 'closed 'Arkham' in favor of BLACKGATE due to the DENT ACT-- Bruce would have funded Jeremiah Arkham the lost state revenues just to handle his 'special' prisoners... Joker is in there or obviously he would have been heard from-- seems the most reasonable... No Death Penalty in Gotham or they would never need ARKHAM... BTW Two-Face is in ARKHAM as well-- the public and everyone mistakenly believe Arkham closed but obviously it wouldn't be... the DENT ACT freed up the cops to make special deals for the Special criminals... the public would be led to believe that Joker went to a federal prison BUT thats too far away from Bats to really 'fly'

Two-Face is dead at the beginning of TDKR. That was the whole point of the Dent Act and HARVEY DENT DAY - offical story, Batman went off his rocker, killed a load of cops and Dent too.
The Joker could have easily been the judge at the show trial.a reply to a post I made a suggest that the Scarecrow was there to represent the idea of 'fear'. If the Joker presided the trail you could argue that it was to represent that idea that the court had no order (chaos).
As for the idea of the Joker having too small a role, you need to understand that this not a film about Joker vs. Batman - that film is called The Dark Knight.

But it wouldn't fit the Jokers character to just sit there, holding faux trials. He'd be out and causing chaos.

I've no idea why some people are so bitter that Joker wasn't mentioned in this film? It's nice though that the novel answers maybe at least a few questions to what may of happened to him.

I'd have loved to see Ledger in the role fulfilled by Jonathan Crane, think it would have been perfect for him. But as Daniel Sillitto points out, he would have been too big a personality to be subservient to Bane in any way.
Not mentioning him was the best thing both dramatically and respectfully.

Joker had nothing to do with this story so him not being even mentioned made perfect sense!

Except that he was the sole reason that Dent comitted all of those crimes which ultimately lead to Batman taking the rap for it all. If it wasn't for The Joker's actions in The Dark Knight, the events in TDKR would have been completely different.
